Extradition of Pakistani citizen accused of bank fraud to Kuwait  

Pakistani government has made the decision to extradite a Pakistani citizen to Kuwait who is implicated in a case of bank fraud.

During a recent federal cabinet meeting, the Ministry of Interior revealed that the Embassy of the State of Kuwait in Islamabad had made a formal request, through the Ministry of Foreign Affairs, for the extradition of Arshad Ali, a Pakistani citizen and the son of Mazhar Ali.

Arshad Ali is a wanted individual, sought by Kuwaiti authorities in connection with Case No. 2138 of 2016 Money Prosecution (211 of 2016), which involves ongoing investigations related to charges of forgery in bank documents.

The Ministry informed the Cabinet that Pakistan has an existing extradition treaty with Kuwait. According to the provisions of Section 7 of the Extradition Act of 1972, the Federal Government has the authority to issue an order to a First-Class Magistrate for investigating the case. The Magistrate will then be empowered to investigate the extradition offense, provided it falls within the local boundaries of their jurisdiction.

It was further disclosed that, based on the International Border Management System (IBMS) travel records, the accused, Arshad Ali, along with Mazhar Ali, arrived at Sialkot International Airport on November 5, 2016.

Taking this information into consideration, the Ministry of Interior has requested approval for the appointment of an Additional Deputy Commissioner (G)/Additional District Judge, ICT, Islamabad, as an investigating officer. Their role will be to conduct a judicial inquiry into the extradition case of Arshad Ali, with the aim of determining whether a prima facie case can be established against the fugitive or otherwise.

The matter has been deliberated upon by the Cabinet, which, in line with previous extradition cases, has designated an Additional District Judge (ICT) as the investigating officer for all such extradition cases.

The President has also directed the Ministry of Law and Justice to expedite the process of delegating federal government powers to the competent authorities.
